Section 1 – Agreement to Terms

These Terms of Use (“Terms”) constitute a binding agreement between you and Youngerstudios (“Company”, “we”, “us”) regarding your access to and use of https://youngerstudios.co.za (the “Site”), including all content, features, and services offered. Your use of the Site—whether browsing, purchasing sample packs, or subscribing to memberships—indicates your acceptance of these Terms, our Privacy Policy, and Terms of Service. If you do not agree, please do not use the Site.

Section 2 – Updates & Revisions

We may modify these Terms at any time by posting updates here. Changes take effect immediately. Continued use after updates constitutes acceptance. Please review frequently.

Section 3 – Site Access & Account Security

Access: We may suspend or discontinue the Site or features at our discretion.
Registration: Certain areas require an account. You agree to provide accurate information and update it as needed.
Credentials: Keep your username and password confidential. Notify us of any unauthorized use. We may disable accounts that violate these Terms or pose security risks.

Section 4 – Ownership & Intellectual Property

All Site content—including designs, graphics, audio files, sample pack artwork, and text—is owned or licensed by Youngerstudios and protected under South African and international IP laws. You may view and download materials only for personal, non-commercial use. Prohibited actions include:

Copying, modifying, or distributing content without permission.
Extracting graphics or audio for reuse in other products.
Removing or altering any proprietary notices.

Section 5 – Brand Marks & Trademarks

The Youngerstudios name, logo, and related trademarks belong exclusively to the Company. Unauthorized use is prohibited. Other trademarks on the Site remain the property of their respective owners.

Section 6 – Acceptable Use

You agree not to use the Site for:

Any unlawful or prohibited activity under local or international law.
Uploading malware or malicious code.
Impersonating others or infringing on others’ rights.
Harvesting data from the Site (e.g., scraping or spamming).

Section 7 – Community Submissions

Interactive features (reviews, comments, forum posts) allow “User Submissions.” By posting, you grant us a worldwide, royalty-free license to use, modify, and distribute your contributions. You represent that you have full rights to your submissions and that they do not violate any laws or third-party rights.

Section 8 – Enforcement & Termination

We may remove or refuse any content, and suspend or terminate your access for violations of these Terms or any unlawful conduct. We may cooperate with authorities on legal matters.

Section 9 – Sample Pack & Membership Clauses

Sample Packs License: When you purchase a sample pack, you receive a non-exclusive, royalty-free license to use the audio in your productions. You may not redistribute or resell the original samples as standalone files or include them in new sample libraries.
Membership Benefits: Membership tiers grant access to exclusive content and community channels. Recurring fees are billed monthly until cancellation. Access remains active until the end of the billing cycle; no refunds for partial periods.

Section 10 – Affiliate & Promotional Links

The Site may contain affiliate links, which earn us commissions at no extra cost to you. Any sponsored content or promotions will be clearly marked.

Section 11 – Disclaimers

The Site and all products are provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted access or error-free downloads. Your use is at your own risk.

Section 12 – Limitation of Liability

To the fullest extent permitted by law, Youngerstudios and its affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of the Site or products.

Section 13 – Indemnification

You agree to indemnify and hold harmless Youngerstudios, its officers, and affiliates against any claims or liabilities resulting from your breach of these Terms or misuse of the Site.

Section 14 – Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved exclusively in South African courts.

Section 15 – Severability & Entire Agreement

If any provision is held invalid, the remainder will continue in effect. These Terms, along with our Privacy Policy and Terms of Service, constitute the complete agreement between you and Youngerstudios.
