Terms of Service for Youngerstudios

Section 1 – Overview

This website is operated by Youngerstudios (“we”, “us” or “our”). Throughout the site, the terms “Service” and “Site” refer to https://youngerstudios.com and all products, memberships, and content offered herein. By accessing or using our Service (including browsing, purchasing digital products, or subscribing to memberships), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional terms referenced here. If you do not agree to these Terms, please do not use our Service.

Section 2 – Eligibility

By using our Service, you represent and warrant that:

You are at least the age of majority in your jurisdiction (18 in South Africa), or you have obtained parental or guardian consent.
You have full legal capacity to enter these Terms and to use the Service in compliance with all applicable laws (including the Electronic Communications and Transactions Act, POPIA, and international regulations).

Section 3 – Account & Security

You may be required to create an account to access digital downloads or membership content. You agree to provide accurate, complete, and current information.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Notify us immediately of any unauthorized use or security breach involving your account.

Section 4 – Purchases & Payments

All prices are displayed in South African Rand (ZAR) unless otherwise indicated. International customers may be charged in local currency, subject to payment processor rates.
We accept payments via PayFast, PayPal, Stripe, and other supported gateways. All payment details are processed securely by third-party providers; we do not store full card data.
You authorize us to charge your chosen payment method for purchases and recurring membership fees.
We reserve the right to cancel or refuse an order at our sole discretion (e.g., suspected fraud, pricing errors).

Section 5 – Digital Product Delivery & Licensing

Delivery: Upon successful payment, you will receive an email with a secure download link or direct access via your account. Download links may have limits (e.g., 5 downloads) and expiry dates (e.g., 14 days).
License: Unless otherwise stated, all digital products (sample packs, project files) are provided under a non-exclusive, royalty-free license. You may use the content in your own compositions, including commercial works, but you may not:
- Resell, redistribute, or repackage the original files.
- Claim ownership of the raw content.
- Include the files in any other sample library for sale.
Full license terms accompany each download and are incorporated by reference into these Terms.

Section 6 – Memberships & Subscriptions

Membership tiers (e.g., R10, R50, R100 per month) grant access to exclusive content as described on the Site.
Recurring payments will be automatically charged at the beginning of each billing cycle until canceled.
You may cancel your membership at any time via your account dashboard; cancellation takes effect at the end of the current period. No prorated refunds for partial periods.
We reserve the right to modify or terminate membership offerings or pricing with 30 days’ notice.

Section 7 – Refund & Returns Policy

Digital Goods: All sales are final once the download link is delivered, except in cases of faulty or incorrect files. You must request a refund within 7 days of purchase by contacting support@youngerstudios.com and providing proof of issue.
Memberships: No refunds for unused membership periods, except where required by law.
Dispute Resolution: In the event of a payment dispute (chargeback), we may provide download logs and transaction records to challenge unwarranted claims.

Section 8 – User Conduct & Prohibited Uses

You agree not to:

Use the Service for unlawful or unauthorized purposes (including hate speech, harassment, or copyright infringement).
Transmit malware, viruses, or malicious code.
Attempt to gain unauthorized access to any part of the Site or our systems.
Scrape, harvest, or store personal data of other users.

Violation of these rules may result in immediate termination of your access.

Section 9 – Intellectual Property

All content on the Site, including text, graphics, logos, and digital products, is owned by or licensed to Youngerstudios and protected by copyright, trademark, and other IP laws.
Unauthorized use of our intellectual property is strictly prohibited.

Section 10 – Disclaimers & Limitation of Liability

The Service and all products are provided “as is” without warranties of any kind, express or implied.
We do not guarantee uninterrupted, secure, or error-free access.
To the fullest extent permitted by law, Youngerstudios and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or any products.

Section 11 – Indemnification

You agree to indemnify and hold harmless Youngerstudios and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your violation of these Terms or your use of the Service.

Section 12 – Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the South African courts.

Section 13 – Changes to Terms

We reserve the right to modify these Terms at any time by posting revisions on this page. Your continued use after changes indicates acceptance of the updated Terms. Please review this page periodically.
